1. Acceptance of Terms By downloading, accessing, or using Clarity Within (the «App»), you agree to be bound by these Terms of Use («Terms»). If you do not agree, do not use the App. You must be at least 18 years old to use this App.
2. Description of Service Clarity Within provides mindfulness and reflection card decks designed to promote personal growth and self-awareness. The App allows users to browse cards, save favorites, and customize their experience.
3. Eligibility You must be at least 18 years of age to use this App. By using the App, you represent and warrant that you are at least 18 years old. If you are under 18, you are not permitted to use the App under any circumstances.
4. User Accounts To access certain features, you may be required to provide an email address and basic account information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
5. Subscriptions and Payments
a) Clarity Within offers auto-renewable subscription plans (monthly and annual). Subscription details and pricing are displayed within the App before purchase.
b) Payment processing: Payment will be charged to your Apple ID account (iOS) or Google Play account (Android) at confirmation of purchase.
c) Auto-renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
d) Renewal charges: Your account will be charged for renewal within 24 hours prior to the end of the current period at the same subscription rate.
e) Managing subscriptions: You can manage and cancel your subscriptions by going to your Account Settings on the App Store (iOS) or Google Play Store (Android) after purchase.
f) Free trial: If a free trial is offered, any unused portion of the free trial period will be forfeited when you purchase a subscription.
g) No refunds: All purchases are final. Refund requests must be directed to Apple (iOS) or Google (Android) through their respective refund processes. We do not process refunds directly.
6. User Conduct You agree to use the App only for lawful purposes. You may not: (a) attempt to gain unauthorized access to the App or its systems; (b) use the App to transmit harmful code; (c) interfere with or disrupt the App’s functionality; (d) violate any applicable laws or regulations.
7. Intellectual Property All content in the App, including but not limited to text, graphics, logos, images, card content, and software, is the property of Manelun or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or reproduce any content without prior written permission.
8. Disclaimer of Warranties THE APP IS PROVIDED «AS IS» AND «AS AVAILABLE» WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. The cards and content are for inspirational and reflection purposes only and do not constitute professional medical, psychological, or therapeutic advice.
9. Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MANELUN AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM: (a) YOUR USE OR INABILITY TO USE THE APP; (b) ANY UNAUTHORIZED ACCESS TO YOUR DATA; (c) ANY CONTENT OBTAINED FROM THE APP.
10. Third-Party Services The App may contain links to third-party services. We are not responsible for the content, privacy policies, or practices of third-party services. Apple Inc. and Google LLC are not sponsors of, and are not responsible for, the App or its content.
11. Apple-Specific Terms (iOS Users) These Terms are between you and Manelun only, and not with Apple Inc. («Apple»). Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support services for the App. In the event of any failure of the App, Apple has no obligation to provide any refund. Apple is a third-party beneficiary of these Terms and may enforce them against you.
12. Data Deletion You may request deletion of your account and all associated data at any time by contacting us at app@manelun.com. We will process your request within 30 days.
13. Changes to Terms We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or via email. Your continued use of the App after changes constitutes acceptance of the modified Terms.
14. Termination We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the App will cease immediately.
15. Governing Law These Terms shall be governed by and construed in accordance with the laws of Republic of Chile, without regard to its conflict of law provisions.
